Photographer Release Agreement
Casa Rondeña Winery Photography Release
This Photographer Release Agreement (“Agreement”) is entered into between Casa Rondeña Winery, LLC (“Winery”), located at 733 Chavez Road NW, Los Ranchos de Albuquerque, NM 87107, and the individual or entity identified below (“Permit Holder”).
By signing this Agreement, the Permit Holder acknowledges and agrees to the following terms and conditions in exchange for access to the Winery property for photography purposes:
- Permitted Use. Access is granted solely for personal, portrait, or event photography during the reserved session time. Commercial photography, including but not limited to product shoots, advertising campaigns, and stock photography, requires a separate commercial use agreement.
- Winery Rights. Casa Rondeña Winery reserves the right to use any photographs taken on the property for promotional, marketing, or social media purposes. The Permit Holder grants the Winery a non-exclusive, royalty-free license to use, reproduce, and display images that depict the Winery property.
- Credit and Attribution. When sharing images publicly (social media, websites, publications), the Permit Holder agrees to credit Casa Rondeña Winery and tag @casarondenawinery where applicable.
- Property Respect. The Permit Holder and their photographer shall not move, rearrange, or alter any furniture, decor, equipment, barrels, or architectural elements on the property without prior written consent. No confetti, glitter, smoke bombs, open flames, or similar materials are permitted.
- Restricted Areas. Access is limited to areas designated by the purchased Photo Pass tier. Production areas, private offices, and areas under active restaurant service are off limits unless specifically included in the pass.
- Liability and Indemnification. The Permit Holder assumes all risk associated with their visit and photography session. The Permit Holder agrees to indemnify and hold harmless Casa Rondeña Winery, its owners, employees, and agents from any claims, damages, injuries, or losses arising from the photography session, including damage to equipment or personal property.
- Insurance. Professional photographers conducting sessions at the Winery are encouraged to carry their own general liability insurance. The Winery is not responsible for damage to or loss of photography equipment.
- Cancellation. Cancellations made at least 72 hours before the scheduled session will receive a full refund. Cancellations within 72 hours are non-refundable. The Winery reserves the right to reschedule sessions due to weather, private events, or operational needs, in which case a full refund or rescheduled date will be offered.
- Conduct. All visitors must adhere to Winery policies, including the prohibition of smoking anywhere on the property. The Winery reserves the right to terminate a session at any time if these terms are violated, with no refund issued.
- Governing Law. This Agreement shall be governed by the laws of the State of New Mexico. Any disputes shall be resolved in Bernalillo County, New Mexico.
